About these terms

These terms govern your use of this website and any purchase you make through it. By placing an order you confirm that you have read them and agree to them. If you do not agree, please do not order.

They should be read alongside the privacy policy, shipping policy, returns policy and supplement disclaimer, which form part of the agreement between us.

Who you are buying from

Veleryn Shop is a sole proprietorship, an individual trading under a business name in the United States. It is not a corporation, LLC, partnership or any other body corporate, has no employees or officers, and any reference on this site to “we” or “us” means that one individual, who is named on the about page.

Veleryn Shop is a retailer. It does not manufacture, formulate, blend, repackage or relabel any product it sells, and it is not affiliated with, endorsed by, or an authorised representative of any brand named on this site.

Eligibility

To buy from this site you must:

• Be at least 18 years old.
• Be able to form a legally binding contract.
• Provide a delivery address within the United States.
• Give accurate, complete information at checkout.

Orders placed for onward export, or through a freight forwarder, are outside these terms and may be cancelled and refunded.

Products and descriptions

Everything sold here is a dietary supplement, regulated in the United States as food rather than as a drug. No product on this site is a medicine and none requires a prescription.

Descriptions are written from the manufacturer’s own published information and from the pack. The label on the product you receive is the authoritative source for ingredients, allergens, nutrition and directions, and it takes precedence over anything on this site if the two ever differ.

Manufacturers change formulations and packaging without notice. Product photographs are supplied by the manufacturer and packaging may vary between production runs. Reasonable effort is made to keep listings current; obvious errors will be corrected rather than honoured.

Orders and acceptance

Placing an order is an offer to buy. Your order is recorded immediately with an order number at status Processing, which confirms it has been received but does not yet mean it has been accepted.

The contract between us forms when the order is dispatched. Until then an order may be declined or cancelled, for example if an item is out of stock, if there is a pricing or description error, if the address cannot be delivered to, or if the order appears fraudulent. If that happens you are told why and anything paid is refunded in full.

Order quantities may be limited. Veleryn Shop holds small quantities and does not sell for resale.

Pricing and tax

Prices are in United States dollars and are shown exclusive of sales tax. Where sales tax applies to your state it is calculated after the order is placed and confirmed to you in writing before any money changes hands.

Shipping is $6.95 for UPS Groundto any US address, free on subtotals of $75.00 or more. Faster UPS services are offered at checkout at the rates published on the shipping policy, and are charged on every order because the free threshold applies to UPS Ground only.

Prices can change at any time, but the price on your order at the moment you place it is the price you pay. If a genuine pricing error is found before dispatch, you will be contacted and given the choice of paying the corrected price or cancelling for a full refund. An obviously mistaken price will not be honoured.

Payment

Veleryn Shop accepts two payment methods, and you choose one at checkout: direct bank transfer or cash on delivery. All amounts are payable in United States dollars.

Direct bank transfer

• The account details are sent to you with your order confirmation. Your order number must be quoted as the payment reference so the transfer can be matched.
• The order is packed and dispatched once the funds have cleared in full.
• An order with no payment received within 7 days of the details being sent may be cancelled and the stock released. You are welcome to reorder.
• Any fee your own bank charges for sending a transfer is yours. A short payment leaves a balance outstanding, which must be settled before dispatch.

Cash on delivery

• The order is dispatched before payment. The full amount, including shipping and any applicable sales tax, is due in cash to the UPS driver at the point of delivery.
• Please have the exact amount ready. UPS drivers do not carry change and may refuse to release a parcel where the exact amount is not available.
• Title in the goods passes to you on payment. Until then the goods remain the property of Veleryn Shop.
• Repeatedly refusing or failing to collect cash on delivery parcels incurs real UPS costs. Where that happens, future orders to the same address or from the same customer may be accepted on bank transfer only.

Delivery and risk

Delivery times given anywhere on this site are UPS business-day estimates, not guarantees, and time is not of the essence. Full detail is in the shipping policy.

Risk in the goods passes to you on delivery to the address you gave. Title passes on delivery where payment has already been received, and on payment where you have chosen cash on delivery. You are responsible for the accuracy of that address and for arrangements to receive the parcel safely.

Cancellations, returns and refunds

An order can be cancelled free of charge at any time before dispatch. After delivery, the returns policy applies in full and forms part of these terms. In short: unopened items can be returned within 30 days, and anything faulty, damaged or incorrect is replaced or refunded with postage paid. Refunds are sent by bank transfer to an account in your name, including where the original payment was made in cash on delivery.

Acceptable use

You agree not to:

• Use this site for any unlawful purpose or to place fraudulent orders.
• Buy for resale, or misrepresent who the goods are for.
• Interfere with the site, attempt to gain unauthorised access, or probe, scan or test its security.
• Scrape, mirror or systematically extract content from the site.
• Submit automated orders or messages, or abuse the contact form.

Access may be refused where these terms are breached.

Intellectual property

The Veleryn Shop name, logo, page design, layout and original written content are owned by the proprietor and may not be copied or reused without permission.

All other trademarks, brand names, product names, logos and product photography belong to their respective owners. They appear here for the purpose of identifying the goods being sold, which is a nominative use, and their appearance does not imply any affiliation with or endorsement by those owners.

No medical advice

Nothing on this site is medical, nutritional or professional advice, and no relationship of practitioner and patient is created by using it. Statements about products have not been evaluated by the Food and Drug Administration, and no product sold here is intended to diagnose, treat, cure or prevent any disease.

Consult a qualified healthcare professional before starting any supplement, especially if you are pregnant, nursing, under 18, taking medication, or managing a health condition. The full supplement disclaimer applies.

Limitation of liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

Subject to that, and to the fullest extent permitted by law:

• The site and its content are provided “as is”, without warranties of any kind beyond those that cannot be excluded.
• Veleryn Shop is not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or opportunity.
• Total liability arising out of any order is limited to the amount you paid for that order.
• Veleryn Shop is not liable for how a product is used after delivery, for a reaction to an ingredient disclosed on the label, or for use contrary to the manufacturer’s directions.

Indemnity

You agree to indemnify Veleryn Shop against claims, losses and reasonable costs arising from your breach of these terms, your misuse of the site, or your use of a product contrary to its label and the manufacturer’s directions.

Force majeure

Veleryn Shop is not liable for failure or delay caused by events beyond reasonable control, including UPS network disruption, extreme weather, supplier failure, utility or network outage, civil disturbance, or action by a government authority.

Governing law and disputes

These terms are governed by the laws of the United States and of the State of CA, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the state and federal courts located there.

Please write to us first. Almost everything is resolved faster and more cheaply by email than by anything else, and you will get a reply from the person who can actually fix it.

If any provision of these terms is found unenforceable, the rest continues in effect.

Changes to these terms

These terms may be updated from time to time, and the date at the top of the page shows when they last changed. The version in force for your order is the version published when you placed it.
